Valaiss on Freemont St., Las Vegas

I’ve had a very bad experience with this company when I visited Las Vegas. Elijah and I believe Joseph approached me in the Fremont Strip. I was under the influence of alcohol and marijuana, and I believe they intimidated and coerced me to sign something that I did not understand. I thought around $500 but it was actually $6,000, which the next morning, I went to the shoppe and told them they took advantage of me, and I had nothing to show for this expense, and asked for a refund and they said there are “no refunds”. Who in their right mind would spend $6,000 on some cosmetic? When the package arrived, which I still don’t know what I ordered, I returned the package unopened. I filed a lawsuit with the District Court of Nevada against Valaiss Switzerland & Cosmetics at Pioneer. The judge has not signed the Motion yet, which request judgement by default for relief demanded since the defendants failed to answer the complaint. I saw one review which suggested a class action lawsuit, which I believe would be in order for this company. So, I having nothing to show for a $6,069 charge and I feel elder abuse would also be a charge in this transaction. Please do not use this company. Unfortunately, You will be sorry.

It sounds like you had a very distressing and potentially fraudulent experience with Valaiss on Fremont Street in Las Vegas. From your description, it appears that you were approached by sales representatives under the influence of alcohol and marijuana, and ended up signing for a product or package that was much more expensive than you realized. You returned the unopened package and attempted to get a refund, which was denied, leading you to file a lawsuit with the District Court of Nevada.

Here are some points and recommendations for similar situations and next steps:

  • Legal Action: You have already filed a complaint with the District Court seeking default judgment because the company did not respond. This is a proper first step. Continue to follow up with the court clerk to ensure your motion is being processed.
  • Consumer Protection: The Nevada Attorney General’s Office has a consumer protection division that handles cases of deceptive business practices. You may consider filing a complaint there, especially since this may involve misrepresentation and potential elder abuse claims.
  • Class Action Consideration: If other customers have experienced similar high-pressure sales tactics and financial harm, this company may be the subject of a class action lawsuit. Monitoring reviews and online reports can help determine if this is already in progress or if there is a potential to join or initiate one.

Additional recommendations to protect yourself and others:

  • Keep all records of the transaction, communications, receipts, and evidence of returning the package unopened.
  • Do not engage with sales representatives on the street who pressure you into signing documents or making purchases, especially under the influence of substances.
  • Consider leaving a review or reporting the incident to consumer review websites to warn other potential customers.
  • If applicable, consult a local attorney who specializes in consumer fraud, elder abuse, or contract law to evaluate if additional claims can be made.

In summary, your situation involves potential fraudulent sales tactics and misrepresentation. You are taking the correct steps through legal channels, and reporting to consumer protection agencies can also help prevent others from suffering similar experiences. Until the court rules on your motion, maintain thorough documentation and consider further legal counsel if necessary.
